Code of Conduct for Federally Regulated Financial InstitutionsMortgage Prepayment InformationPurposeThe purpose of the Code is to ensure that federally regulated financial institutions ("lenders") provide enhanced information in respect of credit agreements secured by mortgages where a prepayment charge could apply ("mortgages") to assist borrowers in making decisions about prepayment of their mortgage.Lenders currently provide substantial amounts of information relevant to mortgage prepayments to consumers in accordance with the requirements in the applicable federal regulations, including but not limited to federal cost of borrowing disclosure regulations and credit business practices regulations. The information that will be provided under this Code is in addition to existing information provided by lenders to borrowers.Application and ImplementationLenders will implement the policy elements of the Code with respect to new mortgages no later than six (6) months from date of adoption of the Code for Element 3 and Element 4; and no later than twelve (12) months from adoption of the Code for Element 1, Element 2 and Element 5. Borrowers will be able to enter information about their mortgage into the calculator to get an estimate of the current prepayment charge. Borrowers will also be able to change the information they enter, such as the amount of the mortgage that has not yet been repaid or the remaining term, so that they can see how the payment choices they make affect the prepayment charge.5. Borrower Access to Actual Prepayment ChargeEach lender will make available a toll-free telephone line through which borrowers can access staff members who are knowledgeable about mortgage prepayments. These staff members will be able to orally provide a borrower with the actual prepayment charge that would apply to the borrower's mortgage at that point in time. These staff members will also be able to provide to a borrower, on request, a written statement of their prepayment charge, accurate as at the time the statement is produced. A good explainatory article by Robert McLister of Canadian Mortgage Trends explaining the pros and cons of Bank of Montreal's just announced 5 year 2.99% rate:BMO Cranks Up the Heat AgainBMO is dead-set on winning mind share among consumers.It's coming back to the market with two new deep-discount rate promos: A 5-year fixed at 2.99% (which starts Thursday, March 8, 2012) A 10-year fixed at 3.99% (which starts Sunday, March 11, 2012) Both of these specials are low-frills, meaning: A Lower Maximum Amortization: 25 years versus 30-40 years elsewhere Less Lump-sum Pre-payment Ability: 10% maximum per year (i.e., 1/2 of the 20% that BMO normally allows) A Smaller Payment Increase Option: Up to 10%, once per year (again, 1/2 of the 20% that BMO normally allows) A Locked Term: The Low-rate Mortgage is fully closed unless you sell the property, refinance (with BMO only), or early renew into another BMO mortgage. In other words, unless you sell, you're not leaving BMO for 5 years, like it or not. Both the 5-year and 10-year promos run for 3 weeks, until March 28, 2012.We've heard talk that TD and RBC will not match BMO's pricing on the 5-year term. We'll see. The last time BMO ran this special, its competitors quickly responded with 4-year rates of 2.99%. Despite the one less year, those competing offers came with all the normal bells and whistles.Unfortunately for competitors, a 2.99% five-year rate makes more headlines than a four-year promo at the same price, and BMO knows it. This deal has garnered almost a dozen major media stories already, and the press release only came out four hours ago.As for BMO's 10-year deal, it is 146 basis points below the nearest Big 6 bank competitors' advertised rates. It is BMO's lowest 10-year rate ever, and it matches ING's current 3.99% offer. (ING was the first bank in Canada to advertise 10-year rates below 4.00%.)With these rates, BMO is starting to make other big banks look increasingly silly. CIBC, National Bank, RBC, and TD are currently promoting 5-year "special offer" rates of 4.04%. That's 105 basis points above BMO (albeit with more flexibility). Those rates border on ridiculous, and they insult the intelligence of increasingly savvy consumers who know that well-qualified borrowers rarely pay anything close to those rates.Yes, we say that knowing that BMO's Low-rate mortgage is highly restrictive and not suitable for most.It is, however, suitable for some. The target market includes many: First-time buyers Rental property owners Owners of 2nd homes The customer should have no foreseeable need to break, increase or aggressively prepay his/her mortgage for five years.In posting more transparent rates than its peers, BMO is taking a page from brokers and smaller rivals. In doing so, it's building credibility with consumers at its competitors' expense.Frank Techar, BMO's Canadian banking head, tells Bloomberg: "The reaction to our January offer was fantastic." With a mortgage market that BMO CEO William Downe admits is "slowing," 2.99% is a big fat worm on a hook. It is bait that gets BMO's phones ringing.It also gives BMO's sales force a chance to upsell people into higher margin mortgages without all the restrictions of BMO's Low-rate product. (There's a lot of that going on, according to the BMO mortgage specialists we've talked to.)With this rate sale, BMO is certain to take flak for fuelling consumer borrowing at a time when high debt levels are worrying policymakers.To that end, Techar maintains that BMO is not fuelling the fire. He tells the Financial Post that these rates "are consistent with the debate around the need to reduce consumer debt levels."In an interview with Reuters, he said: "People are not going to stretch to get the largest mortgage they can with a 25-year amortization product. Because the monthly payments are higher, they...will go to a 30-year amortization product." (He's right.)Downe recently said this to analysts about BMO's Low-rate Mortgage:"We think that's a product that is good for Canadians; it's good for Canada; it's good for our customers, and we intend to continue to promote it in this environment.It's a product that we believe addresses all of the risks that are currently being debated, whether or not the consumer debt levels that are too high in Canada and a possible fallout from economic slowdown and rising interest rates. It helps our customers pay less interest. It mitigates their interest rate risk for five years. It helps them retire debt free by paying off their balance faster, and it works against market price appreciation. In fact, it helps with...house price appreciation, because the shorter amortization reduces the maximum purchase price people can afford."Being a 5-year fixed, this product does mitigate some risk. A 200 basis point rate increase by 2017 would only lift payments $133/month on the average Canadian mortgage of $151,000.As for rumours that policymakers are ticked off by BMO's pricing, the last time anyone looked, it's still a free market. BMO can price as it sees fit within regulations. As long as underwriting standards remain high, God bless it for bringing down rates industry-wide.Even if rates like 2.99% do spur more interest in mortgages, it doesn't mean lenders will approve high-risk borrowers. BMO's average loan-to-value (LTV) is just 60%. More notably, BMO's residential mortgage portfolio has a long-run loss rate of less than 2 basis points (i.e., exceptionally low).Barring a run-up in bond yields, we could now start seeing competitors (like mortgage brokers) respond with full-frills 5-year offers that are just a pittance above BMO's rate. Budget: Highlights of the 2012 federal budgetThe budget will:- Gradually raise the age of eligibility for Old Age Security from 65 to 67 beginning in 2023.- Contain no new taxes or tax increases.- Tell consumers to complain directly to food companies about product labelling.- Eliminate the penny.- Eliminate 19,200 government jobs over three years, including 600 senior executives and 7,200 through attrition.- Reform regulation in the resource industry, including amending the Canadian Environmental Protection Act.- Allow Canadians to claim more goods duty-free at the border. Several years ago, I attended a dialog meeting led by Catholic and Orthodox priests here in Minneapolis. I do not remember the topic. During the Q&A time, someone in the audience complained about the moral decadence in our society. Asserting claims originally made by Jerry Falwell and Pat Robertson, this person insisted that God had allowed 911 terrorist attack to take place because of "homosexuals and abortion" in the U.S. But one of the Orthodox priests, gently, but with firm authority, rebuked him, and said "we in the Catholic and Orthodox traditions start with ourselves. We do not look at other people's sins, but our own... we begin with our own sin, and our own repentance (approximate wording)." I will never forget this event, and the priest's wise words.

During the season of Great Lent, Eastern Orthodox Christians pray every day the prayer of
St. Ephrem the Syrian:

O Lord and Master of my life, take from me the spirit of sloth, despondency, lust of power, and idle talk;

But grant rather the spirit of chastity, humility, patience, and love to thy servant.

Yea, O Lord and King, grant me to see my own transgressions, and not to judge my brother; for blessed art Thou unto the ages of ages.

Every Sunday morning, at the Divine Liturgy, before receiving the Holy Mysteries of Our Lord's Body and Blood, Eastern Orthodox Christians pray aloud with St. Paul: "I believe O Lord, and I confess that thou art truly the Christ, the Son of the living God, who didst come into the world to save sinners, of whom I am chief." (Divine Liturgy of St. John Chrysostom, taken from 1 Timothy 1:14-15).

The Christian who prays the prayer of St. Ephrem or the words of the Apostle should begin with his or her own sins, not those of others. Consider the words of our Lord Jesus Christ in St. Matthew's Gospel:

And why do you look at the speck in your brother’s eye, but do not consider the plank in your own eye? Or how can you say to your brother, ‘Let me remove the speck from your eye’; and look, a plank is in your own eye? Hypocrite! First remove the plank from your own eye, and then you will see clearly to remove the speck from your brother’s eye. - Matthew 5.3-5

In our attempts to cultivate humility, we should also bear in mind the words of St. Paul: "in lowliness of mind let each esteem others better than himself." - Philippians 2.3b
The great thing about Christianity, the Gospel, and the love of God is: we can always start over; we can always start anew, and begin again.

Trailing Spouse Support from Spouses Without Borders

Although male and female spouses have been following their respective partners across borders for Millennia, it wasn’t until the July 15, 1981 issue of The Wall Street Journal when Mary Bralove quoted the term “Trailing Spouse.” It is one of the most difficult elements of an International Career, to find meaning and work for the partners of dual-career couples that did not initiate the move.

They say that renovating a house is the largest challenge to any marriage. If that is true, then the trailing spouse phenomena must run a very close second. Challenges may include, but are not limited to, dual-career challenges where the partner is forced to relinquish their career to join their partner on assignment. Obviously, with all of the new changes and culture shock, the stress on families can be immense. Uprooting children and especially teenagers can have lasting positive and negative effects, depending on how they approach the move. Sponsoring employers may not offer much support for the relocation of the Trailing Spouse and many countries do not have the resources to be of much help . They may have difficulty finding new or meaningful employment. They may suffer from a loss of identity, as every facet of their lives is reshaped and structured. If they are women or girls, they may face restrictions that are tantamount to house arrest, their wardrobe might be inadequate and their credentials may be become moot. Even something as simple as having blonde hair or blue eyes can become a challenge.

In most cases the Trailing Spouse phenomena is experienced in military, diplomatic and government groups. With the world changing as quickly as it does, it has also become a factor in the private sector. But, because it is recognized as a phenomenon, it means that it has happened to enough people that common recurring issues have surfaced, and solutions have been tried and tested. The key thing is to understand, is that you are not alone, and Spouses Without Borders is there to offer help, resources and support.

Here at Henderson Campeau we are getting excited for Christmas and all the fun  that it brings. It's great to see the city glowing with Christmas lights, the atmosphere in the neighborhood joyous, and the snow starting to fall.
Skiing season is here and we are excited about that. I'm sure many Calgarians are excited as well.
With it being the holiday season it is a great time to come down to Kensington and support the local businesses.

The 12 days of Christmas, a time for giving

To continue on with my theme of giving during these holidays, this post is about donations and their tax treatment.

With the 12 days of Christmas here, it is time to be giving presents.  Those presents could be a donation to a charitable organization. 

For personal tax purposes a charitable donation gives rise to a tax credit.  The credit obtained,
is 15% federally and 10% provincially (Alberta) on the first $200 of donations.
The credit then increases to 29% federally and 21% provincially on any amounts above $200.

Another benefit of donations is that you can claim both your own and you spouse's donations on one return, therefore benefiting from the higher credit on the amount above $200.

As a household if you contributed a total of $500.  The tax dollars you would receive back would be:
($200x 25%) = $50  plus ($300 x 50%) = $150.  Total = $200.     So on a donation of $500 you would be giving to a great cause; then at tax time reducing your tax bill by $200.  You only have to pay a net $300 and the charity gets $500.  Everyone wins,  awesome.

If you own and operate a corporation.  Charitable donations are a fully dedcutible expense for tax purposes.

So if you are thinking of giving these season,  from a tax perspective it is a smart thing to do.  Any donations made before December 31, 2011 would be credits on your 2011 tax return.

Winter is here. What a wakeup call. -30 this morning in Calgary.
As a result we are staying close to the office and getting lots of work done. The holidays were great for both partners. We have been getting out and skiing, relaxing and of course eating. We hope everyone enjoyed the season and have has a wonderful start to 2012.
